Sale Agreement - Trial
The Sale Agreement - Trial is suitable for horse sales where the seller has agreed to allow the buyer to trial the horse for a period of time before purchase. The agreement is 7 pages in total and includes the following:
trial period to be agreed between the parties and written into the contract;
10% non-refundable deposit;
remaining 90% of price to be paid before the trial ends;
provisions to protect the seller and the horse (ie. horse maintenance requirements during trial, etc)
title and risk passing;
vet check during trial period;
basic warranties: seller must disclose all health and soundness conditions, vices or behavioural issues;
buyer decision to proceed with sale or terminate agreement after trial period; and
termination provisions and what happens upon termination (payments, horse collection, etc).
