Broodmare Lease Agreement
This lease agreement is suitable for leases of broodmares.
This lease is for an “off property” arrangement (ie. the horse does not live with the owner, but either with the lessee, or at an agistment centre). The agreement is 8 pages in total and includes the following:
one foal to be born during the lease term;
agreement terminates when foal is weaned;
lessee can select the stallion, but parties can agree on any special conditions and include in the schedule;
ownership of foal and mare clearly stated;
set the weekly lease fee (can be $0 if free lease);
all maintenance and breeding related expenses to be paid by the lessee;
insurance clause (can be crossed out and deleted if the horse is not insured);
accident and emergency protocol;
owner can inspect with 7 days notice;
basic warranties: full disclosure of any health and soundness conditions, vices or behavioural issues required;
liability and indemnity clause; and
additional standard termination provisions.
